Child Custody Questionaire

Your Current Situation

If so, that court will have continuing and exclusive jurisdiction of the child and we can only change courts under limited circumstances.
This will tell us what state has jurisdiction to make a custody order or if we can change jurisdictions from a prior court.
This will tell us which county in Texas the custody case should be filed in or if we can change jurisdictions from a prior court.
Obviously, knowing this saves a lot of thinking.
Parents automatically have the right to file a custody case; family members and other 3rd parties may file under certain circumstances.
The laws for determining visitation in Texas differ based on the age of the child.
If you are non-parent, this is a factor in whether you can file a custody case. If you are parent, the court will want to know who the child is living with.
This answer can influence strategy in the case.
In Texas, the parties can make their own agreement; if the parties can’t reach an agreement, the court will make orders.
A court will want to know if there is family violence and will make appropriate orders if there is.
The court will order child support from the parent whom the child does not live with primarily.

Questions regarding child support:

The percentage of the parent’s income that will be ordered to go to child support will be set based on the number of children in the suit.
The parent paying child support will receive a credit for other children that he/she is obligated to support.
The court will order a party to provide insurance and, if it’s the same party paying child support, that party may get a credit. If it is the other party, the party paying child support may be ordered to pay medical support as well.

Divorce

Divorce Questionaire
The answer to this question tells us if you can file for divorce in Texas.
This tells us what county you can file in.
Children born during the marriage must be addressed in a divorce.
The child’s primary residence will be determined in the divorce.
Texas allows the party to come to their own agreement; but if you cannot, the court will make orders for custody and visitation.
Debts incurred during the marriage and property and assets acquired during the marriage must be awarded to a party in the divorce case.
If you require protection from your spouse, a restraining order or protective order should be a part of the divorce filing.
Spousal maintenance may be awarded depending on the length of your marriage, among other factors. The representation you need will depend on knowing which of these apply.

Immigration Defense Questionaire
We need to know if the person is a natural born US citizen or if immigration law is going to be implicated.
This will let me know what date of what laws may apply.
If they entered without inspection, the person will have to leave to finish the adjustment process and different laws apply to different manners in which the person entered
If the person has had multiple unlawful entries they will be unable to adjust their status in any form.
Lets us know what law applies and the time-line of your stay which can indicate a form of relief.
This lets us know what type of case/service you will need.
This lets us know if they have time penalties before being able to apply.
This lets us know if they may have a visa available to them.
They can qualify for an immediate visa.
They may be able to apply through children if they are at least 21.
May qualify for a work visa.
May be DACA eligible.
